I opted to write my next blog entry for Forward Movement on this issue. It spurned a lot of discussion in our post describing the use of free music albums to generate interest in a product.
As most lawyers don't deal with this issue as much + the field as a whole tends to be slow (even resistant) to change, I wrote this as food for thought:
